These Terms of Service govern your use of our website and your purchase or booking of products and services from Cartmax Pet Stop. Please read them before placing an order, creating an account, submitting information, or booking a service.

Who we are and acceptance of these Terms

Cart Max Fiji Pte Ltd, trading as Cartmax Pet Stop (“Cartmax”, “we”, “us” or “our”), operates the website cartmaxpetstop.com, our retail branches and the services described in these Terms.

By using the website, creating an account, submitting a form, placing an order, booking a service or accepting a quotation, you agree to these Terms and any service-specific terms, written quotation, consent form or policy presented to you. If a service-specific document conflicts with these Terms, the service-specific document applies to that service to the extent of the conflict.

You must be at least 18 years old, or have the involvement and permission of a parent or legal guardian, to place an order or authorize services for an animal.

Website information and availability

We aim to keep product descriptions, images, prices, stock information, service details and website availability accurate. Colours, packaging, dimensions and appearance may vary from photographs, and manufacturers may change packaging or specifications. Please confirm any feature that is essential to your purchase before ordering.

We may correct errors, update information, suspend a feature, or withdraw a product or service at any time. General website content is provided for information only and is not veterinary diagnosis or individualized professional advice.

Accounts and customer information

You are responsible for giving accurate, complete and current information and for protecting your account credentials. Tell us promptly if you suspect unauthorized use of your account. We may suspend or close an account where reasonably necessary to protect customers, animals, our systems or our business, or where the account is used unlawfully or in breach of these Terms.

Information submitted for orders, bookings, microchip records or pet travel must be accurate. We may rely on the information you provide, including owner details, animal history, medical information, measurements and travel documents.

Orders and contract formation

An order placed through the website is an offer to purchase. An automated acknowledgement confirms receipt but does not necessarily mean we have accepted the order. We accept an order when we confirm fulfilment, make the goods available for collection, dispatch them, or otherwise expressly accept it.

We may decline or cancel an order before acceptance because of stock errors, pricing errors, payment concerns, supply restrictions, legal requirements, delivery limitations or suspected misuse. If we cancel after receiving cleared payment, we will refund the amount paid for the cancelled item or order using the original payment method where practicable.

Prices, taxes, promotions and quotations

Unless clearly stated otherwise, prices shown for local purchases are in Fijian dollars. The final price, applicable taxes, delivery charges and other fees will be shown at checkout, in your booking confirmation or in a written quotation before payment is required.

Promotions, discounts and free-shipping offers apply only during the stated period and subject to their published conditions. Promotions cannot be combined unless we say otherwise. We may correct an obvious pricing or promotional error before accepting an order.

A quotation or estimate is valid for the period stated in it. Estimates may change if the scope changes or if actual veterinary treatment, transport, airline, government, quarantine, laboratory, accommodation or third-party costs differ from the assumptions used. Where practicable, we will seek approval before a material additional cost is incurred, except where urgent action is reasonably required to protect an animal’s welfare.

Payment

Payment must be made using a method we accept and by the time stated at checkout, in the booking confirmation or quotation. You confirm that you are authorized to use the payment method supplied. Orders and services may be withheld until cleared payment, an agreed deposit or other approved arrangement is received.

Card and other electronic payments may be processed by third-party payment providers. Their service terms and security processes may also apply. We do not ask customers to send full card details by ordinary email or messaging applications.

Stock, substitutions and quantity limits

All products are subject to availability. We will not substitute a materially different product without your agreement. We may apply reasonable quantity limits, particularly for promotions, restricted products or items in limited supply.

Collection, delivery and risk

Click and collect. We will notify you when an order is ready. Please bring the order confirmation and suitable identification. Orders not collected within a reasonable period after reminders may be cancelled or restocked, subject to any non-recoverable costs and applicable law.

Delivery. Delivery dates are estimates unless we expressly agree otherwise in writing. You are responsible for providing a complete and accessible delivery address and safe delivery instructions. Additional costs caused by an incorrect address, failed delivery or redirection may be charged where lawful and disclosed.

Inspection. Please inspect goods promptly. Report missing, damaged or incorrect items as soon as reasonably possible and provide photographs or other information that helps us assess the issue. Delay in reporting does not remove any right that cannot lawfully be excluded.

Returns, refunds and exchanges

Nothing in these Terms excludes, restricts or modifies a consumer guarantee, warranty, right or remedy that cannot lawfully be excluded under the Fijian Competition and Consumer Commission Act 2010 or any other applicable law.

Faulty, unsafe or incorrectly supplied goods. Contact us with proof of purchase and details of the issue. Where required by law, we will provide the applicable remedy, which may include repair, replacement, refund or another lawful solution depending on the circumstances.

Change of mind. Subject to any different policy stated at purchase, you may request a change-of-mind return within 7 calendar days after purchase or delivery. Acceptance is at our discretion and normally requires proof of purchase, original packaging, and goods that are unused, unopened, complete and suitable for resale. Delivery, installation and special-order costs are not normally refundable.

Return exclusions. For health, hygiene, safety and welfare reasons, we do not ordinarily accept change-of-mind returns of opened food or treats, medicines, supplements, parasite-control products, grooming or hygiene products, bedding used by an animal, personalized goods, clearance goods, or any item that has been worn, fitted, assembled, contaminated or damaged after supply. These exclusions do not apply where a remedy is required by law.

Manufacturer warranties may apply in addition to your legal rights. We may ask you to return an item for inspection before determining the appropriate remedy.

Pet products, medicines and responsible use

Choose products appropriate for the animal’s species, size, age, health, behaviour and intended use, and follow all labels and manufacturer instructions. Supervise animals when using toys, restraints, braces, clothing, crates and similar products. Stop use and obtain veterinary advice if a product causes pain, injury, breathing difficulty, skin irritation or other adverse effects.

Medicines, pharmacy items and regulated products will only be supplied in accordance with applicable law and any prescription or veterinary authorization requirements. Product information on the website does not replace a consultation with a qualified veterinary professional.

Veterinary consultations and animal-care services

An online booking request is not confirmed until we accept it. Arrival times for home visits and service times are estimates and may change because animal emergencies and clinical priorities can arise.

The owner or authorized caregiver must give complete and accurate medical, vaccination, medication, allergy, temperament and bite-risk information, and must have authority to consent to treatment. We may require written consent, a deposit, restraint measures, diagnostics, referral or other reasonable safety steps.

Veterinary medicine involves professional judgment and biological uncertainty. We will provide services with reasonable care and skill, but no particular clinical outcome can be guaranteed. If unexpected findings or urgent welfare concerns arise, we will try to contact the authorized person before materially changing the agreed plan. In an emergency, decisions may be made within the authority given and as reasonably necessary for animal welfare.

The website and online booking portal are not emergency services. If an animal may be in immediate danger, contact the clinic by telephone or seek the nearest available emergency veterinary assistance without waiting for an online response.

Grooming and other handling services

Tell us about health conditions, recent surgery, pregnancy, parasites, skin problems, anxiety, aggression or previous handling incidents before the service. We may stop, modify or refuse a service where continuing would create an unreasonable risk to the animal, staff or others. Necessary veterinary attention, additional handling or de-matting may involve extra charges if disclosed and authorized, except where urgent welfare action is reasonably required.

Microchip services and records

Microchips are identification devices and are not GPS trackers. Successful identification depends on the chip being readable and the registry information remaining accurate. You are responsible for checking the recorded owner and animal details and notifying the relevant registry and us of changes to ownership, contact details or the animal’s status.

Registry availability, database matching and recognition by third parties may be outside our control. We do not guarantee that every scanner, registry, authority or jurisdiction will recognize or retrieve a particular chip record.

Pet travel, import and export assistance

Where we assist with pet transport, import, export or relocation, our role and fees will be set out in the quotation or service confirmation. Unless expressly stated, we act as a coordinator and do not control decisions or schedules of airlines, freight providers, laboratories, veterinarians, quarantine facilities, customs or government authorities.

The owner is responsible for accurate information, timely documents, animal fitness, required vaccinations and treatments, permit compliance, and disclosure of relevant medical or behavioural issues. Entry rules, routes, availability, testing requirements, government fees and airline conditions may change without notice.

We do not guarantee permit approval, acceptance by a carrier, a particular flight, transit time, quarantine outcome or entry into another country. Deposits and third-party costs already committed may be non-refundable if a booking is changed, delayed, refused or cancelled, subject to applicable law and the written quotation.

Cancellations, rescheduling and no-shows

Cancellation and rescheduling conditions may vary by service and will be stated in the booking confirmation, quotation or consent form. Please give as much notice as possible. We may retain or apply a reasonable deposit to work performed, reserved capacity or non-recoverable third-party costs where this was disclosed and is permitted by law.

We may reschedule or cancel because of clinical emergencies, staff availability, unsafe conditions, severe weather, transport interruption, supplier failure or other circumstances outside reasonable control. We will notify you and provide an appropriate rescheduling, credit or refund option where required.

Customer conduct and animal safety

Customers must act lawfully and respectfully and take reasonable steps to keep animals, staff and visitors safe, including using suitable leads, carriers or restraints. We may refuse or end service for abusive, threatening, fraudulent or unsafe conduct, or where an animal cannot be handled safely with the available facilities and information.

Third-party services and links

The website may use or link to payment, delivery, mapping, registry, messaging, social-media or other third-party services. We are not responsible for the content or independent acts of third parties that we do not control. Your use of those services may be governed by their terms and privacy policies. This clause does not reduce our responsibility for our own obligations or for parties for whom we are legally responsible.

Intellectual property and permitted website use

The website and its original text, branding, graphics, photographs, layout and software are owned by or licensed to Cartmax and are protected by applicable intellectual-property law. You may access and print reasonable extracts for personal, non-commercial use. You must not copy, scrape, republish, sell, reverse engineer, disrupt or misuse the website or our content without permission, except as allowed by law.

Reviews, messages and other user content

If you submit a review, image, testimonial, message or other content for publication, you confirm that it is truthful, lawful, relevant and does not violate another person’s rights. You give us a non-exclusive, worldwide, royalty-free licence to display, reproduce and adapt that content for operating and promoting our business. We may remove content that is unlawful, misleading, abusive, private, irrelevant or otherwise inappropriate.

Privacy and electronic communications

By providing an email address or telephone number, you agree that we may send transactional communications relating to orders, bookings, animal care, payments, microchip records and travel services. Marketing messages will be handled in accordance with applicable law and the choices made available to you.

Disclaimers and limitation of liability

To the fullest extent permitted by law, we exclude implied terms that may lawfully be excluded and are not liable for indirect, incidental, special or consequential loss that was not reasonably foreseeable when the relevant contract was formed.

Where liability can lawfully be limited, our aggregate liability arising from a particular product or service will not exceed the amount paid for that product or service. This limitation does not apply to fraud, wilful misconduct, liability for death or personal injury caused by negligence, professional obligations that cannot lawfully be limited, or any consumer right or remedy that cannot lawfully be excluded or restricted.

Your responsibility for losses caused by misuse

You are responsible for loss reasonably caused by your unlawful use of the website, deliberate breach of these Terms, infringement of another person’s rights, or materially false information you provide. This does not make you responsible for loss caused by our negligence, breach of law or failure to meet our obligations.

Events outside reasonable control

Neither party is responsible for delay or failure caused by an event outside reasonable control, including severe weather, natural disaster, epidemic, government action, border or quarantine change, industrial disruption, transport cancellation, utility or network failure, or supplier interruption. Payment remains due for goods or services already supplied and for properly disclosed, non-recoverable third-party costs, subject to applicable law.

Changes to these Terms

We may update these Terms to reflect changes in law, technology, our operations or services. The updated version will be posted on the website with a new effective date. Changes apply prospectively and do not alter an order or service contract already accepted unless required by law or agreed with you.

Governing law and resolving concerns

These Terms are governed by the laws of the Republic of Fiji. The courts of Fiji have non-exclusive jurisdiction, subject to any mandatory rights available to you.

If you have a concern, please contact us first so we can try to resolve it promptly. Nothing in these Terms prevents you from contacting the Fijian Competition and Consumer Commission, another competent regulator, or a court or tribunal with jurisdiction.

General terms

Severability. If any provision is invalid or unenforceable, it will be read down or removed only to the extent necessary, and the remaining provisions continue.

No waiver. A delay or failure to enforce a right is not a waiver of that right.

Assignment. You may not transfer your rights or obligations without our consent. We may transfer our rights or obligations as part of a business reorganization or sale, provided this does not reduce your legal rights.

Entire agreement. These Terms, together with the accepted order, quotation, booking confirmation, consent form and incorporated policies, form the agreement for the relevant transaction or service.
